重磅!9月11日后移民官可跳过RFE或NOID直接否决申请!

今天(7月13日)移民局出台一项新的Memo,说明自9月11日起收到的申请,如果申请人提交的材料中没有提交全部要求的支持申请的初步证据,移民官将有权直接拒绝该申请,而不是像以往一样先提出RFE补件要求或NOID否决意向。这项规定涉及到的申请类型包括了除Differed Action for Childhood Arrivals (DACA)之外的所有申请类型,即包括H-1B、H-1B extension、H-1B transfer、O-1、L-1、亲属移民(I-130)、职业移民(EB1/2/3)、I-485(转换身份)等。 移民局的这项Memo中明确举例说明以下两种情况所提交的申请会被直接否决: 如果一项豁免申请只有很少或没有相关支持性证据,移民官可以直接否决申请; 如果一些移民法规、法令或表格填写指南要求在提交申请时必须同时提交某项官方文件、其他表格或证明申请资格的证据,但却没有提交这些材料,那么移民官可以直接否决申请。例如,亲属移民或职业移民需要在提交I-485转换身份的同时提交I-864表格(支持宣誓书),但是申请人并没有提交I-864,那么移民官可以直接拒绝该申请,而不用先给出RFE来要求补寄I-864。 按以往的惯例,如果申请中缺少一部分支持性文件,移民局会发出RFE或NOID,要求申请人补交材料,只要申请人在规定时间内补寄相关材料,就不影响案件的审理。但是从9月11日之后,一旦移民官认为申请中缺乏所要求的支持性证据,可以跳过RFE和NOID的环节,直接否决申请。 虽然移民局表示这项规定可以减少对那些连基本要求都不满足却占相应名额的申请,可以提高案件处理速度,并不是针对申请者无罪的错误(innocent mistake)或对支持性文件要求的误解,但是这其实标志着移民局对于各项申请的审理严格度又上了一个新台阶,也为申请者增加了申请难度。 不能算好消息的好消息是,2019财年的H-1B申请不会被计入在这个范畴中,因为这项规定说明在9月11日后收到的申请才会启用这个审查程序。 目前的移民政策日渐紧缩,金石律师事务所提醒各位,认真准备自己的各项申请,将所有要求的材料一同提交,不能存在侥幸心理认为如果缺少文件或材料移民局会一定会要求补件。
